Merchants Leasing iPad 2 Giveaway Sweepstakes
Official Rules
Sweepstakes Dates: Beginning August 1, 2011 and ending November 30, 2011.
Merchants Leasing, its subsidiaries and affiliated companies ("Company"), will conduct the Sweepstakes substantially as described in these rules, and by participating, each participant agrees as follows:
1. Description of Sweepstakes/Participation.
A. Dates of Sweepstakes: The Sweepstakes will be conducted beginning August 1, 2011 and ending on or about November 30, 2011.
B. How to Enter: NO PURCHASE IS NECESSARY. PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE ODDS OF WINNING. Odds of winning vary greatly depending on number of entrants. Void where prohibited.
Online: During the Promotion Period go to http://www.merchantsleasing.com/fleetcast/ and register for Fleetcast. After filling out and submitting the registration form completely, you will automatically receive one (1) entry into the Sweepstakes.
Limit one (1) Sweepstakes entry per person, per Promotion Period. Each entry will be eligible to win in each of the two drawings, which will occur between August 1, 2011 and ending November 30, 2011. Valid Sweepstakes entries must contain all information requested. Incomplete and/or multiple entries will be disqualified. Void in Rhode Island and in any other State where Giveaways of this type are prohibited by law.
C. How To Play: Winner(s) will be randomly selected from all entries received for each of the two drawings, which will occur on the last day of each chosen month after 12:00 p.m. EST starting in August 1, 2011 through November 30, 2011. Winner(s) will be notified by telephone. If a winner cannot be contacted from the information provided on the registration form, the Company reserves the right to select another winner in its sole discretion.
2. Prize(s).
The prize(s) that may be awarded to the eligible winner(s):
iPad 2 prizes.
Prizes are non-transferable, not redeemable for cash and not exchangeable for any other prize. No substitution will be made except as provided herein at the Company's sole discretion. The Company reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. All prizes must be redeemed within 30 days after being notified they have won the sweepstakes, including signed copies of release and tax forms when required. If a winner is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner's prize, in its sole discretion.
3. Eligibility and Limitations.
Merchants Leasing iPad 2 Sweepstakes (the "Sweepstakes") is open only to legal U.S. residents who are at least eighteen (18) years old at the time of entry. Employees of Merchants Leasing and their affiliate companies, the Sweepstakes' participating sponsors and their advertising agencies as well as members of the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all applicable federal, state, provincial, and local laws and regulations. Participation constitutes entrant's full and unconditional agreement to these Official Rules and the Company's decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Winner assumes all liability for use of the prize.
If a potential winner cannot be contacted, or fails to sign and return the affidavit of eligibility and liability/publicity release (or Declaration of Compliance) within the required time period, potential winner forfeits prize. Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon such full compliance and fulfilling all requirements set forth herein. The Company will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
4. Limitations of Liability.
Participants are restricted to use of ordinary and typical computer equipment and Internet access. The Company disclaims all liability for the inability of a participant to complete or continue an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Company's control, or otherwise. The Company disclaims any liability for received entries due to technical difficulties or transmission errors. The Company disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. The Company is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Sweepstakes, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes. The Company disclaims all liability for any unauthorized human intervention in any part of the entry process or the Sweepstakes or; technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes, unless Sweepstakes is discontinued or over, in which entrant shall have no further rights or remedies whatsoever.
5. Publicity.
By participating, where allowed by law, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other sweepstakes and waive any claims to royalty, right, or remuneration for such use. By participating, where allowed by law, participants agree that the Company may disclose personal information obtained from participants in the Sweepstakes to third parties and use such information for marketing and other purposes.
6. Release.
By participating, each participant and winner waives any and all claims of liability against the Company, sweepstakes' sponsors, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents, (collectively, the "Released Parties") for any personal injury or loss which may occur from the conduct of, or participation in, the Sweepstakes, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.
7. Taxes. Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes and paying any expenses associated with any prize(s), which are not specifically provided for in the official rules.
8. Conduct and Decisions
By participating in the Sweepstakes, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Sweepstakes, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and the Company's decisions concerning such disputes shall be final. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Sweepstakes, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS SWEEPSTAKES, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THELEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPATE TO THE FULLEST EXTENT PERMITTED BY LAW.
9. General Conditions.
Each winner must submit proof of eligibility and sign the Company's release form to claim the prize. No purchase necessary to participate or win. Purchase does not increase chance of winning. Void where prohibited. Odds of winning depend upon the number of participants. The Company may substitute prizes, amend the rules or discontinue the Sweepstakes at any time if any fraud, technical failures or any other factor beyond Company's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by the Company in its sole discretion. Company reserves the right in its sole discretion to disqualify any individual it believes to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, The Company reserves the right to seek damages from any such person to the fullest extent permitted by law. The Company's failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Sweepstakes. For a copy of the rules, or where required by law, a list of winners, please send your request within 30 days of the end of the giveaway by mail with a stamped, self-addressed return envelope with Sweepstakes name and addressed to: Merchants Leasing, PO Box 16415, Hooksett, NH 03106, U.S.A. All entries become the property of the Company and will not be returned.
